1. Acceptance of Terms

Welcome to VinoPrep. By downloading, installing, or using our mobile application, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our application.

These Terms constitute a legally binding agreement between you and VinoPrep. Please read them carefully.

2. Description of Service

VinoPrep is a wine education application that provides:

• Access to interactive wine region maps
• Detailed appellation guides and facts
• Study materials for WSET and other wine exams
• Interactive quizzes and flashcards
• Progress tracking and statistics
• Premium content (via subscription)

The service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the service at any time.

3. User Conduct

When using VinoPrep, you agree to:

• Use the app for lawful purposes only
• Not attempt to reverse engineer, decompile, or disassemble the app
• Not use the app to transmit malicious code or viruses
• Not interfere with or disrupt the service or servers
• Not use automated systems to access the app
• Respect intellectual property rights
• Not share premium subscription access with others

4. Intellectual Property Rights

App Content:
VinoPrep and all its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

Educational Content:
The educational material provided (maps, region guides, quiz questions) is created for study purposes. While we strive for accuracy, wine regulations and facts can be complex and subject to change.

User Content:
You retain ownership of your bookmarks, notes, and other personal content created within the app. By using the app, you grant us a license to store this content locally on your device.

5. Subscriptions and Payments

Premium Subscriptions:
VinoPrep offers optional premium subscriptions that provide enhanced features. Subscription details:

• Subscriptions are billed through the Apple App Store or Google Play Store
• Payment is charged to your app store account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage or cancel your subscription through your app store account settings

Refunds:
Refund requests should be directed to Apple or Google, depending on where you made your purchase. We do not directly process refunds.

Lifetime Premium:
Lifetime subscriptions grant permanent access to premium features for the lifetime of the app. This is a one-time purchase and does not auto-renew.

6. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using VinoPrep, you agree to the terms of our Privacy Policy.

Key points:

• Your study data is stored locally on your device
• We do not sell your personal information
• You can delete your data at any time
• Notifications are optional and can be disabled

7. Disclaimers and Limitations of Liability

Service Availability:
While we strive to provide continuous service, we do not guarantee that the app will be error-free or uninterrupted. We may experience downtime for maintenance, updates, or due to circumstances beyond our control.

Content Accuracy:
We make reasonable efforts to ensure the accuracy of our wine education content. However, we are not liable for any errors, omissions, or inaccuracies. Wine laws and regional regulations change frequently.

Educational Purpose:
VinoPrep is a study aid designed to assist with wine education. We are an independent tool and are not affiliated with, endorsed by, or synonymous with the Wine & Spirit Education Trust (WSET), Court of Master Sommeliers (CMS), or any other certification body. Use of this app does not guarantee exam success.

Limitation of Liability:
To the fullest extent permitted by law, VinoPrep shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app.

8. Third-Party Services and Links

VinoPrep may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services.

Third-party services we use include:

• Apple App Store / Google Play Store
• Payment processors

You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any third-party services.

9. Termination

We reserve the right to terminate or suspend your access to VinoPrep immediately, without prior notice, for any reason, including but not limited to breach of these Terms.

Upon termination:

• Your right to use the app will cease immediately
• Locally stored data will remain on your device unless you uninstall the app
• Active subscriptions will be handled according to app store policies

10. Geographic Restrictions

VinoPrep is available worldwide, but some features may not be available in all regions due to technical or legal restrictions. We reserve the right to limit the availability of the app in any geographic area at our sole discretion.

11. Changes to Terms of Service

We reserve the right to modify these Terms at any time. We will provide notice of material changes through the app or via the email associated with your account (if provided).

Your continued use of VinoPrep after any changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you should discontinue use of the app.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the app shall be resolved through:

1. Good faith negotiations
2. Mediation (if negotiations fail)
3. Binding arbitration or courts of competent jurisdiction in France (as a last resort)

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and VinoPrep regarding the use of our app, superseding any prior agreements.
